Effective: July 2026

1. Scope of Application
These Warranty Terms and Conditions apply to all deliveries made by Matechnia UG (haftungsbeschränkt) to entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB).

2. Statutory Warranty
The statutory warranty provisions under German law shall apply to all products supplied by Matechnia UG (haftungsbeschränkt), unless otherwise agreed in the applicable General Terms and Conditions of Sale (B2B).

3. No Independent Commercial Warranty
Matechnia UG (haftungsbeschränkt) does not provide any independent commercial warranty regarding the quality, condition or durability of its products.
Any warranty commitment shall only be valid if expressly confirmed in writing by Matechnia UG (haftungsbeschränkt).

4. Genuine Parts, OEM Products and Aftermarket Spare Parts
Depending on the product, the goods supplied may consist of:
  • Genuine parts;
  • OEM products; or
  • High-quality aftermarket spare parts.
Any manufacturer's warranty shall be governed exclusively by the warranty terms issued by the respective manufacturer.
Matechnia UG (haftungsbeschränkt) does not provide any separate manufacturer's warranty for such products.

5. Conditions for Warranty Claims
Warranty claims are subject, in particular, to the following conditions:
  • the product has been installed correctly and professionally;
  • all installation instructions have been followed;
  • the product has been used exclusively for its intended purpose;
  • no unauthorised modifications have been made; and
  • all required maintenance intervals have been observed.

6. Exclusions from Warranty
Warranty claims shall not apply where damage has resulted from:
  • improper installation;
  • incorrect assembly;
  • overloading;
  • improper operation;
  • normal wear and tear;
  • inadequate maintenance;
  • use of unsuitable operating fluids or lubricants;
  • unauthorised modifications;
  • repairs carried out by third parties; or
  • external force or accidental damage.

7. Inspection Prior to Installation
The buyer is responsible for inspecting all delivered products before installation with regard to:
  • product identity;
  • correct fit;
  • technical specifications; and
  • completeness.
Warranty rights may be limited where the defect was already apparent prior to installation and could reasonably have been identified before the product was installed.

8. Warranty Claim Procedure
Warranty claims shall be handled in accordance with the Return and Complaints Policy of Matechnia UG (haftungsbeschränkt).
To assess a warranty claim, we may request, among other things:
  • invoice number;
  • OEM reference number;
  • serial number;
  • photographs;
  • description of the defect; and
  • identification plate.

9. Warranty Remedies
Where a warranty claim is accepted, Matechnia UG (haftungsbeschränkt) shall, at its sole discretion and to the extent permitted by law, decide whether to:
  • repair the product;
  • supply a replacement product;
  • issue a credit note; or
  • refund the purchase price.
The buyer is not entitled to demand any particular remedy.

10. Exclusion of Consequential Costs
To the extent permitted by applicable law, Matechnia UG (haftungsbeschränkt) shall not be liable for any costs or losses relating to:
  • removal or installation of products;
  • labour costs;
  • machine downtime;
  • rental equipment;
  • production losses;
  • travel expenses;
  • transportation costs;
  • loss of profit; or
  • any other indirect or consequential damages.
Nothing in these Warranty Terms and Conditions shall exclude or limit any mandatory statutory rights.

11. Manufacturer's Warranty
Where products are supplied with a manufacturer's warranty, only the warranty terms issued by the respective manufacturer shall apply.
Unless otherwise agreed, any claims arising under a manufacturer's warranty must be asserted directly in accordance with the manufacturer's applicable warranty procedures.

12. Severability
Should any provision of these Warranty Terms and Conditions be or become wholly or partly invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
